Former Deputy President of the Nigerian Senate, Ovie Omo-Agege, has condemned the reported declaration of the seat of Udu State Constituency representative, Collins Egbetamah, as vacant by the Delta State House of Assembly, describing the action as unconstitutional and a violation of due process.<\/p>\n\n\n\n

In a statement issued on Wednesday, Omo-Agege alleged that Egbetamah, whom he described as the duly elected representative of Udu State Constituency, was removed without being accorded a fair hearing.<\/p>\n\n\n\n

He argued that the decision was “hasty, arbitrary, oppressive, and illegal” and said it undermined the interests of the people of Udu, the Urhobo Nation and Delta State.<\/p>\n\n\n\n

The former senator questioned the House’s reliance on Section 109(1)(g) of the Constitution, contending that the provision recognises exceptions where a lawmaker’s defection results from a division within his or her original political party.<\/p>\n\n\n\n

According to him, the circumstances surrounding Egbetamah’s defection were neither subjected to legislative scrutiny nor determined by a competent court before the seat was declared vacant.<\/p>\n\n\n\n

Omo-Agege further maintained that the constituency’s electoral mandate could not be extinguished through what he described as a voice vote conducted in a single legislative sitting, insisting that the lawmaker was constitutionally entitled to a fair hearing before any decision affecting his mandate could be taken.<\/p>\n\n\n\n

Recalling his own experience as a senator, he said a similar attempt to remove him from office was successfully challenged in court, stressing that due process must always prevail over political expediency.<\/p>\n\n\n\n

He also alleged that the action was politically motivated, accusing the ruling party in the state of using unconstitutional means to discourage defections. He claimed that Egbetamah had faced political pressure during his three years in the House because of his membership of the All Progressives Congress (APC).<\/p>\n\n\n\n

Omo-Agege urged the Delta State House of Assembly to reverse its decision and grant the lawmaker the fair hearing he said was denied him. He also called on the judiciary to expedite proceedings should the matter be brought before the courts to ensure that Udu State Constituency is not left without representation.<\/p>\n\n\n\n

The Delta State House of Assembly had not issued an official response to Omo-Agege’s statement as of the time of filing this report.<\/p>\n\n\n\n

In another development, the Gender Mobile Initiative (GMI), in collaboration with the Centre for Gender and Development Studies (CGDS), Delta State University (DELSU), has organised a one-day Campus Safety Initiative aimed at promoting awareness of sexual harassment prevention and strengthening peer advocacy among students.<\/p>\n\n\n\n
