Court Declares Murray Owner of Disputed Abraka Land, Awards ₦2 Million Damages

The High Court of Justice, Delta State, sitting in the Abraka Judicial Division, has declared Mr. Akusu Onomine Murray the lawful owner of a disputed parcel of land at Ofremu Dafe Quarters, Abraka, and awarded him ₦2 million in general damages for trespass.

The judgment was delivered on April 21, 2026, by Justice Samuel I. Okeleke in Suit No. HCA/18/2022 between Mr. Akusu Onomine Murray and Chief Blessing A. Ojarikre.

The court held that the claimant had established ownership of the land, measuring approximately 200 feet by 100 feet (1,852.680 square metres) and covered by Survey Plan No. DT/SC/975/0243/2012, through credible oral and documentary evidence.

According to court records, Murray filed the suit on May 23, 2022, seeking a declaration of title to the land, a perpetual injunction restraining the defendant from interfering with the property, a refund of ₦250,000 allegedly paid for moulding blocks, ₦10 million in damages for trespass, and other reliefs.

The court noted that although the defendant was duly served with the originating processes and subsequent hearing notices, he neither entered an appearance nor filed a defence throughout the proceedings.

Giving evidence before the court, Murray testified that he purchased the land from the defendant on May 2, 2012, for ₦1.5 million, in which the transaction was documented with a Deed of Conveyance and Survey Plan.

He further told the court that in 2018, he paid the defendant an additional ₦250,000 to mould blocks for fencing the property, but the work was never carried out and the money was not refunded.

According to the claimant, he discovered in August 2021 that an unauthorised building was being erected on the land, after a solicitor’s demand letter received no response, he instituted legal action.

To support his claims, the claimant tendered a Deed of Conveyance, a Survey Plan, photographs of the disputed property, a solicitor’s letter, a UBA statement of account, and a Certificate of Compliance, all of which were admitted in evidence.

In his judgment, Justice Okeleke held that while declaratory reliefs cannot be granted merely because a defendant fails to defend a case, the claimant successfully proved his case on the strength of his own evidence.

The court found that the Deed of Conveyance and Survey Plan established the claimant’s title to the land, while the photographs tendered before the court proved acts of trespass, it also held that the claimant established payment of the ₦250,000 for moulding blocks through documentary evidence.

Consequently, the court declared Murray the lawful owner of the disputed property and granted a perpetual injunction, restraining the defendant, his agents, servants, and privies from interfering with the claimant’s possession of the land.

Justice Okeleke also ordered the defendant to refund the ₦250,000 paid for moulding blocks and awarded the claimant ₦2 million as general damages for trespass. No order was made as to costs.

A former Vice-Chancellor of Delta State University, Abraka, Prof. Victor Peretomode, has proposed a tripartite governance model to sustain excellence in the institution.

Peretomode proposed the model at DELSU’s 12th valedictory lecture held on Thursday, September 24, 2026, at the university’s 750 Lecture Theatre, Site III.

The lecture was titled, “DELSU and the Burden of Expectation: The Challenges of Being Delta State’s Premier University and Rethinking Governance for Sustainable Excellence.”

He said as the state’s premier university, DELSU carries triple burdens — aspirational, political and operational — which translate into expectations such as expanding access to university education for Deltans, accommodating qualified indigenes, advancing state-specific development priorities and producing morally sound and employable graduates.

Peretomode, a Professor of Educational Administration and Higher Education, said the challenges could be addressed through his proposed “Peretomode Tripartite Model of Governance for Sustainable Excellence,” anchored on three pillars: Leadership Integrity, Funding Predictability and Quality Assurance.

Tension As GLK, Okada Collide In Abraka

Published

By God’stime Oyeh

An accident involving a GLK 350 and a commercial motorcyclist happened around 11:30 a.m., reportedly after a case of wrong-lane driving.

According to eyewitnesses, the motorcyclist, popularly known as an “Aboki” bikeman, was coming from the Campus 2 area when he was allegedly hit by the GLK 350 car.

The little damage to the car caused some tension at the scene as both parties tried to explain what happened.

Eyewitnesses said the motorcyclist seemed to be at a disadvantage during the confrontation with the car driver- who was clearly trying to oppress the motorcyclist which led vigilantes and other bystanders to step in and calm things down before it got out of hand.

Things reportedly got more heated when some area boys arrived and tried to help settle the issue. The GLK 350 driver defended himself and shared his version of events, but some witnesses felt his explanation didn’t quite match what they saw happen.

As arguments continued and tempers rose, and with the car driver still wanting to oppress the motorcyclist, the Vigilantes took it upon themselves to caution him since he wasn’t trying to make peace…the matter was eventually taken to the police station for proper investigation and resolution.
